RETENTION OF AN EMPLOYEE UNDER IRISH SOCIAL INSURANCE LEGISLATION FOR A TEMPORARY POSTING OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)
Notes for completion:
- Persons employed in Ireland who are sent by their employer to work outside the European Economic Area* (EEA) are normally COMPULSORILY subject to Irish Social Insurance legislation for at least the first 52 weeks of their posting. If you are an Irish employer posting an employee outside the EEA, you should complete this form prior to posting, in order to prevent complications arising with your Social Insurance obligations. This original form should be returned, at least four weeks prior to posting, to PRSI Special Collection Section, Social Welfare Services Office, Cork Road, Waterford. If your employee is being posted to a number of countries outside the EEA, you should also complete section E of this form, indicating the first country of posting in section D. If your employee is being posted to another country WITHIN the EEA, you should apply for an E101 Certificate on the form entitled "Employee Application for E101 Certificate", available from PRSI Special Collection Section at: (01) 704 3000 - Ext. 6012/3/4 or (051) 356012/3/4, mailto:e101@eircom.net.
- Ireland has Bilateral Agreements on Social Security with the United States of America, Canada, Québec, Australia and New Zealand. Postings to these countries are dealt with under the terms of each relevant Agreement.
- Postings to the European Economic Area of Non-EU nationals are dealt with under EU Reg 1408/71 with effect 1 June 2003.
- Postings to Switzerland are dealt with under EU Reg 1408/71 with effect from 1 June 2002.
