Exceptions to further backdating of payments

We will not backdate payment of Illness or Occupational Injury Benefits beyond six months if you failed to claim on time because of:

  • Lack of knowledge about your entitlements
  • Lack of knowledge by someone acting for you
  • Lack of knowledge by third parties
  • an agency other than the Department of Social and Family Affairs gave you incorrect information or advice or
  • an individual or agency other than the Department of Social and Family Affairs failed to act.
